  1. Wow – I will have to disagree with all these answers.

I have personal experience with this.
A payday loan place is not like credit.
You are essentially writing a bad check – which is a federal offense.
When writing a bad check – they will take you to jail.
    It’s FRAUD.

I had a friend that wrote a bad check.
They came to her apartment – all the cops lights were on.
They took her away in handcuffs and left her kid with me.
I didn’t even know what to do with that kid.

  2. You can’t go to jail for this. They are trying to scare you.

  3. No you can never go to jail because of debt in this country. Other countries may be a different story but not in the US.

  4. There are no debtors prisons.

You can be sued and a judgement can be issued against you.

  5. You can go to jail if you cannot agree to some payment arrangements with this company. If it has been two years and nothing has been paid toward it, you can expect to go to jail.
I would attempt to get a lawyer to assist you.

  6. Not for the debt itself but if you wrote a bad check to cover it- you can be arrested for fraud.

  7. You can’t go to jail for ANY debt in ANY US state. The person that made the treat CAN go to jail for violating the Federal Fair Debt Collections Practices Act, but they won’t.

The collector’s PRIMARY job is to SCARE you into throwing money at them them before you EAT. They will tell you to rob a bank if they think it will get you to pay them.

Judy: Your answer is 100% WRONG. The payday lender KNEW they were taking a check without sufficient funds to cover it. Fraud is NOT involved. If this were a criminal offense, everyone EMPLOYED by the payday lender would, by definition, be a criminal.

  8. Don’t listen to Deb, she’s lying. There is no way you can go to jail for not repaying a loan, no matter what. Millions of people can’t pay their bills and none of them go to jail. This is 100 % the case in every state in America.

In fact the Payday people broke the law. They violated the Fair Debt Collections Practices Act which makes it illegal to threaten jail over a debt. You should call your consumer protection division in your area. You are actually the victim and could sue them for a lot of money – no kidding.
